Rollover Accidents

More and more SUVs are on our roads each year and, unfortunately, we’ve also seen a rise in SUV rollover accidents. SUVs are more likely to roll over than other vehicles due to a higher center of gravity and more narrow track, and accidents involving these vehicles can also result in more serious injuries, particularly head injuries. If you or a loved one has been injured in an auto accident due to another driver’s negligence, we at Agruss Law Firm are here for you every step of the way to ensure that your rights are protected and you are fully compensated for your injuries and losses.

While some SUV drivers enjoy sitting at a higher level than in a regular car, this can lead to a false sense of security which can cause them to speed, even in poor weather conditions. According to statistics from the National Highway Traffic Safety Administration (NHTSA):

  • SUV roller accidents result in about 11,000 deaths per year;
  • Rolling over in an SUV increases the chance of a severe injury by over 36%;
  • Over 50% of all fatalities in single-vehicle accidents result from rollover accidents;
  • As much as 90% of all single-vehicle accidents involve a rollover.

Many SUV models have been recalled over the years due to the risk of rollovers, as well as failure to meet standards for roof safety established by the NHTSA; many SUVs do not have roll-bars and their roofs can collapse inward due to the force of an accident and/or rollover.

Many rollover accidents are “run-off-the-road” accidents, which can occur due to poor weather, wet/icy roads, speeding, or reckless or intoxicated driving, and other causes; some begin with “fishtailing,” in which the driver loses control of the vehicle and attempting to correct the steering may result in going off-road or rolling over. Here are the four common types of rollovers:

  • Lateral force rollover – A vehicle moves too fast around a curve and rolls over due to the high center of gravity;
  • Ramp rollover – The vehicle rolls when only one side goes up a ramp or similar change in height;
  • Sideways skid rollover – Lost traction in the rear wheels results in the wheels or vehicle itself striking an object and rolling over;
  • Site-slop rollover – The vehicle is off-road, intentionally or not, and uneven terrain results in a rollover.

Due to the poor design of SUV roofs, they can collapse inward in rollover accidents and result in serious injuries or death for those inside the vehicle; some injuries sustained in these accidents may include spinal cord injuries (resulting in full or partial paralysis), cervical neck fractures, back injuries, and brain injuries. An auto manufacturer can potentially be legally liable for defective design in certain cases, while drivers on the road must always be held legally liable for negligence which directly results in an auto accident and injuries.
