Is auto insurance mandatory in Illinois?
Yes. Under Illinois state law, drivers are required to have liability insurance coverage for at least $50,000 per accident, $25,000 per person, and $15,000 for property damage (625 ILCS 5/7-601), and drivers who fail to comply may be subject to a license-suspension according to Ch. 95 1/2, par. 7-601. Illinois drivers are also required to have “uninsured motorist coverage” in an amount equal to their policies’ liability coverage according to 215 ILCS 5/143a. While some cars may be required to have additional comprehensive insurance (which covers property damage not related to accidents, such as vandalism or theft), this is not required under Illinois law.
In some cases, drivers who were responsible for an auto accident do not have sufficient liability coverage to compensate the victim for his/her injuries, and these victims may be eligible to file an “under-insured motorist claim” with their auto insurance company to be compensated for their injuries and losses.
